The following is a paper prepared by CAHRO as a financial strategizing aid for developing human relations commissions.  

FINANCIAL STRATEGY OF THE HUMAN RELATIONS COMMISSION

The __________ Human Relations Commission needs staff and resources to meet the responsibilities and obligations mandated by the Board of Supervisors.  The purpose of this paper is to explore possible ways to gain the support needed for the Commission.

Problem Statement

Increasing  racial and ethnic tension, escalating hate violence, and concerns for promoting harmonious pluralistic communities and resulted in a proliferation of human relations commissions in California that has not been seen since racial riots plagued America in the mid 1960's.  The activities of the commissions are not changing and serving as a vehicle to bring human relations issues to the attention of decision-makers.  However, the issues the commissions face currently are more complex and include:

  1. the influx of new immigrants,
  2. the perception by people of color and the poor that the Federal  government  is  no longer concerned with their problems and is antagonistic toward them
  3. the illicit marketing and  use of  drugs as  a survival strategy by growing numbers of young people;
  4. the dwindling  need for  blue collar workers and family farmers  resulting   from  the   growing  dominance  of multinational  corporations  whose  primary  concern is reducing the costs of production
  5. people who are homeless.

Commissions are being asked by local  governments to attempt to  deal  with  the  increasingly complex issues facing American society. At the same time the budgets of  local governments are being squeezed  because of  taxing restrictions and court rulings forcing budgeting for jails.  Supervisors  are  unable  to ignore existing or  potential court  mandates to spend on incarceration.  Remaining funds are directed toward other  mandated and essential services.

While  human  relations  commissions  are  not usually given priority budgeting two points are raised on their behalf:

  1. money used to increase  the  capacity  of  the criminal justice  system  to  respond  to  criminality  is  more efficiently used by a human relations commission since it  focuses  on  preventing and reducing criminality at criminality at its source, and therefore reduces the need for more jail cells (at $100,000+ per cell it is not too difficult to be persuasive)
  2. the negative image cast  on  a  community  that suffers from community tension and racial or other forms of conflict  can  destroy  an otherwise healthy business climate and further limit the tax base relied on to support other activities.

Issues

The question is whether a ___________ human relations commission can carry out its mandates when the fiscal restraints on the _____________ are strong.  In order to answer the question several issues need to be addressed:

  1. Can a human relations commission carry out its responsibilities without staff support or budget?
  2. What level of support should a __________ expect to provide to human relations commission?
  3. Can a commission augment its budget through fee for services?
  4. What are the positive and negative implications of seeking external support for commission activities?

Discussion of Funding Issues:

1.  Can a human relations commission carry out its responsibilities without staff support or budget?

     Groups of people will always come together to solve problems that need cooperative solutions.   However, community organizers find that  people generally can be expected to donate their time and efforts when; the problem is immediate and pressing, they have a reasonable expectation to resolve the problem, and they feel they are making progress.

     Commissions that are unstaffed or understaffed have difficulty holding regular meetings in the absence of a crisis requiring a response.  When action is needed they usually do no more than offer verbal support to individuals or organizations asking for help.

     An effective human relations commission capable of fulfilling its responsibilities in a sustained way require staff support and budget.

2.  What level of support should a ____________ expect to provide to a human relations commission before it creates one or mandates tasks for it?

     The ___________ should expect to provide staff for the Commission.  This staff is expected to:

  1. Act as liaison between the Commission and the chief executive officer and the legislative body;
  2. Help the Commission develop and implement a work plan;
  3. Receive and investigate human rights complaints
  4. Help prepare and post agendas
  5. Carry out staff activities designated by the commission
  6. Conduct studies, prepare reports and gather information as directed

3.  Can a commission augment its budget through fee for services?

Housing and Employment

In California the State Department of Fair Employment and Housing contracts exclusively with both departments for the enforcement of employment and housing anti-discrimination laws.  The state has the authority to subcontract with local governments for the enforcement of housing and employment anti-discrimination laws, however local governments have not pursued the potential for subcontracting in California.

Conflict Resolution

Recent state legislation in California allowed for increasing filing fees in designated civil cases and counties are authorized to use a portion of the new revenues for the support of conflict resolution programs.  Commissions may incorporate conflict resolution programs into their activities and generate support from the filing fees.

Racial, ethnic, religious and minority violence

Currently, state legislation is pending for the support of "Human relations Center" to serve as a focal point for local efforts to address crimes motivated by racial, ethnic, religious or minority hatred.  If the legislation passed in its current form the __________ could apply for financial support as a center.

4.  What are the positive and negative implications of seeking external support of commission activities?

     Public grants are usually given to ensure the delivery of a service.  The range of public services that can be provided by human relations commissions, e.g. conflict resolution, homeless programs, fair housing programs, etc. is fairly narrow and are often provided for by other community agencies.  As a result, expectations for external financial support should generally be limited to programs meeting new or special concerns.
     Grant and foundation support will not eliminate the need for __________ resources to operate the activities.  However external support can be used to enhance the activities of the commission and provide some of the resources needed to enable the commission to accomplish its work plan.

Public Agency Grants:

    Most public agency grants, appropriate for the human relations commission in a ___________ the size of __________, are already being used by a myriad of other organizations, and will probably be useful only in starting a new project.  Public agency grants, when they are available, have advantages and disadvantages:

The positive side:

  1. they generally include sufficient support to cover all operating costs,
  2. support will often continue until the need is perceived as being somewhat ameliorated,
  3. obligations will generally be met

The negative side:

  1. they require extensive reporting and evaluation
  2. the activities are generally rigidly described
  3. the amount available for support is subject to the political budget process and the level of funding from year to year is relatively unpredictable

Foundations and Private Philanthropy

     Philanthropic interests cover the whole spectrum of human activity, but most philanthropic organizations are concerned with generating new ideas, and want someone else to pick up the ongoing costs of the programs they create.
     This type of support is most useful for a commission that does not want to get into the business of operating projects, but wants to serve as a catalyst to ensure that project are developed to meet the human rights needs of the people in the ___________.

The positive side

  1. the grants may be received more quickly than public agency grants
  2. the foundation may provide technical assistance to assist in ensuring the success of the project
  3. guidelines and evaluation requirements are generally fairly lenient and the concern focuses on the achievement of the planned objectives rather than paperwork and extensive evaluation

The negative side

  1. philanthropic support varies but with the exception of United Way most support is only given to get project off the ground
  2. foundations often restrict their support to nonprofit corporations, and the commission may need to set up a separate organization to act as fiscal agent
  3. many foundations and philanthropists will only provide program funds so that commission operating costs will need to be supported by the __________.

External financial assistance can enhance the activity of the Commission and may be necessary tot he implementation of the work plan.  However it is unlikely that the Commission will be able to be effective without a commitment on the part of the __________ to provide basic personnel and office support.

RECOMMENDATIONS

A.  The ____________ should provide an office and core staff for the Commission.

     The immediate personnel needs of the commission are for a full-time Executive Director and Administrative Assistant dedicated to carrying out Commission business.  The sooner the _________ responds to this urgent need the sooner the Commission can get on with the task of implementing its workplan.

B.  The __________ should attempt to identify personnel within the workforce who have the requisite skills to act as Criminal Justice Specialist and temporarily assign one to work with the Commission

C.  Work to develop a hate violence prevention and response center should continue and external funding should be sought to subsidize the Criminal Justice Specialist position.

     A Criminal Justice Specialist is urgently needed to develop relationships with the law enforcement agencies in the ___________ and to enable the Commission to respond to urgent resident requests for help.  This position may be attractive to a current ____________ employee who could be loaned to the Commission if the position does not conflict with his/her current duties.  A subsequent expansion of the tasks of the criminal justice specialist to include the administration of a system of hate violence prevention and response should make it possible to attract public or private funds to support the position.

D.  The ____________ should assist the Commission in contracting for work study students and interns to carry out its workplan.

     Much of the Commission workplan requires the use of graduate students and researchers.  Often there are minimal costs that need to be paid to gain the involvement of subsidized students.  The ___________ should allocate some funding to the Commission to enable it to make use of these relatively inexpensive sources of skilled support.

E.  The ____________ should provide the support and resources needed for the Commission to develop a coordinated volunteer program.

     The strength of the commission largely depends on its support from its clients - the residents of the ____________.  In the broadest sense the task of the Commission is to bring the community together and opportunities need to be provided for the broader community to get involved in a non-technical way with Commission activities.  Annual human rights awards dinners, inter cultural activities, fundraising for special projects, and a myriad of other commission projects provide opportunities for individuals and organizations to participate in Commission activities and develop a working relationship with it.
     While volunteers do not require compensation, their activities require coordination and logistical support.  The ___________ should be prepared to provide the resources for staff coordination and logistical support for volunteer activities.

F.  The _________ should explore the possibility of subcontracting with the California Department of Fair Employment and Housing to enforce state and federal laws on employment and housing discrimination.

     What is routine in many other states has not been seriously considered in California because the state laws have been held to pre-empt local government action in the field of discrimination.  Yet, there is no prohibition on the state subcontracting out its responsibilities just as federal agencies subcontract with the state to assist in enforcing anti-discrimination statutes.
