ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL CERRITO AMENDING THE EL CERRITO MUNICIPAL CODE, TITLE 2 ADMINISTRATION, BY ADDING A NEW CHAPTER 2.60, HUMAN RELATIONS COMMISSION

THE CITY COUNCIL OF THE CITY OF EL CERRITO DOES HEREBY ORDAIN AS FOLLOWS:

DIVISION I:  CHAPTER 2.58, HUMAN RELATIONS COMMISSION, IS HEREBY ADDED TO THE EL CERRITO MUNICIPAL CODE TO READ AND PROVIDE AS FOLLOWS:

2.60.610  Title

     This Chapter shall be known as the "Human Relations Commission Ordinance."

2.60.020  Purpose

     The purpose of this Chapter shall be to establish a Human Relations Commission in the City of El Cerrito  to develop positive human relations through education, encouragement of greater respect and understanding between people, their equal opportunity rights under the law and the recognition of the racial, ethnic, religious and cultural diversity of the El Cerrito community.  The purpose of the Human Relations Commission shall be to initiate educational and cultural programs, promote tolerance and mutual respect between all persons and evaluate and make recommendations regarding discrimination charges levied against the City, upon the direction of the council.

2.60.030 Membership

     The Human Relations Commission shall consist of seven members who shall be residents of the City.   Commission members shall be generally representative of the demographics of the City including the racial, religious, age, gender, ethnic, and other groups.

2.60.040  Appointment

     Members of the Commission shall be appointed by majority vote of the entire council.

2.60.050  Term

     Members of the Commission snail serve for a term of four (4) years, or until their successors are appointed, unless removed from office as specified in section 2.60.070.   However, for purposes of establishing staggered terms,  the initial appointments may be for terms varying between one (1) and four (4) years as the council may decide.

2.60.060  Powers and Duties

     The Human Relations Commission shall have the responsibilities as provided in this section and such other powers and duties as the council may, from time to time, decide:

  1. Upon request of the council, to study and make recommendations regarding problems in the City which arise from alleged discrimination prohibited by state and federal law.
  2. Upon request of the council, to study, evaluate and mediate, incidents of alleged discrimination arising in or concerning the community and its citizens to the extent such functions are not preempted or prohibited by Title 3 of the El Cerrito Municipal Code, the Personnel Rules and Regulations, the California Fair Employment 6r Housing Commission or any other state or federal agency.  
  3. Evaluate and disseminate educational and informational material relating to the elimination of all forms of prejudice, and discrimination and promotion of tolerance and understanding.
  4. Initiate and encourage educational and other appropriate activities to seek to discourage or prevent discrimination where
    possible or prevent discrimination where possible.
  5. Provide information and technical assistance to, and cooperate with, other public agencies, organizations, institutions and persons engaged in activities and programs intended to eliminate prejudice and discrimination
  6. Consult and maintain contact with other public agencies, community organizations concerned with interracial,  inter-religious,   and intercultural understanding, and such other private organizations and institutions to further the objective of eliminating discrimination
  7. To review achievement of the City' s equal opportunity program and provide an annual report to the City staff for any recommendations it may make to the council.
  8. Develop  and recommend to the council additional programs and practices designed to further Commission objectives.
  9. Perform such other duties as the council may direct.

2.60.070 Removal of Members

     Members of the Human Relations Commission serve at the pleasure of the council and may be removed from office by a majority vote of the entire council.

2.60.080  Quorum

     For the purpose of transacting business, a quorum or the Human Relations Commission shall consist of a simple majority of the members.

2.60.090  Officers

     At the first meeting of each calendar year, the members of the Human Relations Commission shall select its officers.  Conduct of Commission business shall otherwise be governed by rules of procedure adopted by the Commission.

DIVISION II    SEVERABILITY CLAUSE

     If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance.  The Council hereby declares that it would have adopted the ordinance, and each section, subsection, sentence, clause,  or phrase thereof,  irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid.

DIVISION III  EFFECTIVE DATE

     This ordinance shall take effective thirty (30) days after passage, and shall, within fifteen (15) days after passage, be posted in accordance with f36933 of the Government Code of the State of California with the names of those City Council members voting for and against it.
     The foregoing ordinance was introduced at a regular meeting of the City Council of the City of El Cerrito, held on the 21st day of February, 1989.

PURPOSE AND AUTHORITY OF THE COMMISSION

The ordinance creating the __________ Human Relations Commission in (date) declares:

It is the public policy of the county that all persons residing or visiting in the county,  irrespective of their  age, race, religion, color, sex, ancestry, national origin, handicap, or sexual orientation, may enjoy an equal opportunity to live, grow, learn, work, play, worship and exercise the responsibilities of citizenship, unhampered by invidious discrimination. To  effectuate  this  policy  the __________ Human Relations Commission is hereby established ….

This Human Relations Commission shall operate within the County's unincorporated area and shall coordinate and cooperate with all cities within the County.  The Human Relations Commission shall operate within any incorporated city which adopts a resolution in support of this ordinance and requests participation of the Human Relations Commission.

The general purposes of the ____________ Human Relations Commission shall be to foster peaceful relations in the interest of preserving the public peace among citizens of different races, religions, and national origins; and to promote positive human relationships for the purpose of insuring public peace, health, safety and the general welfare.

The responsibilities of the __________ Human Relations Commission shall be as follows:

  1. To foster mutual respect and understanding among all racial, religious and nationality groups in the community.
  2. To  make such studies in any field of human relationship in the community as in judgment of the commission will aid in effectuating its general purpose.
  3. To inquire into incidents of tension or conflict among or between various racial, religious and nationality groups, and to take action by means of conciliation, conference, and persuasion to alleviate such tensions and conflict
  4. To conduct and recommend such educational programs as, in the judgment of the commission, will increase good will among inhabitants of the community and open new opportunities into all phases of community life for all inhabitants.

The obligations of the ______________ Human Relations commission shall be as follows:

  1. To hold conferences, and other public meetings, in the interest of the constructive resolution of racial, religious and nationality group tensions and the prejudice and discrimination occasioned thereby
  2. To issue such publications and reports of investigation as an its judgment will tend to effectuate the purposes of this article.
  3. To enlist the cooperation and participation of the various racial, religious, and nationality groups, community organizations, industry and labor organizations, media or mass communication, fraternal and benevolent associations, and other groups in an educational campaign devoted to fostering among the diverse groups of the community mutual esteem, justice and equity.
  4. To encourage and stimulate agencies under the jurisdiction of the ___________ Board of Supervisors and the City Councils of Cities which adopt this chapter to take such action as will fulfill the purpose of this chapter.
  5. To submit an annual report to the ___________ Board of Supervisors and to the City Councils of Cities which adopt this chapter.

SELECTION OF COMMISSIONERS

The ordinance which created the ____________ Human Relations Commission states:

  1. The commission shall consist of fifteen (15) members.
  2. The membership shall be broadly representative of the general public including, but not limited to members of business, labor,  religious groups, education, criminal justice, community organizations, and city representatives characteristic of the County's diverse population with respect to sex, sexual orientation, ethnicity, disability, economic disadvantage or age.
  3. Commission members shall be appointed by the Board of Supervisors as a whole from  among individuals formally applying or nominated for membership, taking into consideration, among other things, the various religious, racial, nationality and political groups in the County.  All members of the commission  must be county residents and at least one commission member must reside in each supervisorial district.

Terms

  1. The Commissioners, upon appointment, shall serve a term of three (3)  years until their successors are duly appointed; but the first Commissioners shall classify themselves by lot so that  five members  serve for three (3) years, five serve for two (2) years and five serve for  one (1).   Any vacancy shall be filled for the unexpired term in the same manner as the original appointment,
  2. Commissioners map not be appointed to more than two (2) full three pear terms.  This does not include initial appointment by lot or unexpired terms of less than three (3) years.
  3. A vacancy shall exist and shall be reported to the  Board of Supervisors whenever a commissioner has three (3) consecutive absences from regular meetings of the commission
